Documentary Channel Sues Over Trademark

Boult Cummings intellectual property litigator, Sam Lipshie, comments on this article regarding the recent trademark infringement lawsuit filed by the Documentary Channel, a Nashville-based channel, against Pyxix Corp., a California-based company offering programming through several web sites.

Pyxix uses the words "Documentary Channel" on its website to direct visitors wishing to view documentaries. Lipshie says these types of lawsuits are not uncommon. He explains that companies using the same name as a competitor can dilute the value of the name and cause confusion in the marketplace.
