Economic Incentives


Structuring economic incentives to entice companies and other organizations to locate or expand their facilities involves a variety of unique legal needs. Businesses, municipalities and industrial development boards have chosen Boult Cummings to assist in these efforts because of our specific expertise in this area and our strength in the area of Real Estate & Finance. 

We have experience in large land assemblies for industrial parks, the TVA mega-site program, and all aspects of permitting, entitlements, land use, and industrial development revenue and municipal financing. Working with attorneys in our real estate and tax areas, we assist at all stages of development, including site acquisition, negotiation with railroads and providers of utilities, and construction and equipment acquisition. 

We can help clients secure economic incentives for job creation and capital investment, and we can assist with federal, state and local tax matters. We frequently work with local industrial development agencies and various state agencies, including departments of economic and community development, revenue, trans­portation, environment and conservation. 

We also have particular expertise in structuring Payment in Lieu of Tax (PILOT) agreements and their related tax increment financing arrangements.
