Franchise Law

Boult Cummings Franchise attorneys have found that a combination of legal experience and a high level of organizational ability are necessary in order to be successful for our clients in the area of franchise law.  There are many levels to the franchising process and we have the ability to counsel clients through every phase.  We draft Uniform Franchise Offering Circulars and the franchise or license agreements that define the complicated relationship between a franchisor and its franchisees.  In combination with our franchise knowledge, we have significant experience in trademark law, which helps us ensure the proper protection and use of our clients' valuable intellectual property by their franchisees.  We also have experience managing the complex process of state registrations and compliance with the Federal Trade Commission Rule.

In addition to franchising within the United States, we also have the ability to assist with franchise counsel in jurisdictions outside of the United States by utilizing our membership in TAGLaw, one of the world's leading legal networks with more than 150 independent members in over 90 countries.  TAGLaw provides our firm access to top law firms around the world, which is particularly important in the globalization of franchising as the laws vary based on location.

Our attorneys have represented franchisors in a diverse range of industries, including lodging, health care, eBay sales, and others.  In addition to representation of franchisors, we assist individuals who are considering the purchase of franchises by reviewing their offering documents on a timely basis.  Because of our experience representing franchisors, we can better advise potential franchisees and assist them in evaluating a particular opportunity in the franchise area.
