Appellate Ruling May Impact Nursing Home Admissions Procedures

Boult Cummings attorney, Mike Brent, was quoted in a Nashville Post.com article discussing the ramifications of a Tennessee Court of Appeals decision involving a wrongful death lawsuit filed by Nina McKey of Lawrenceburg, TN for the death of her mother, Ruby Irene Brewer. The court's decision in McKey's case established a precedence to the Tennessee Health Care Decisions Act established in 2004. This act was set up to ease the process of making end-of-life healthcare decisions. From the outcome of McKey's case, Brent felt that, "the Health Care Decisions Act is going to be strictly interpreted...especially the provision requiring physician review."
