Restaurant Owners Are Wary of Workers' Comp Insurer

Restaurant owners across Tennessee are worried they may again be liable for a bankrupt workers' compensation fund. Two years ago the trust ran out of money, holding restaurant owners liable, and now the state Department of Commerce and Insurance has signed a deal to transfer the restaurant association's bankrupt trust liabilities to Brentwood National Insurance Co. This company is a small, unrated insurance company.
Randy Rayburn, owner of Sunset Grill and Midtown Cafe, has hired Boult Cummings attorney, Nathan Ridley, to negotiate with the state for a guarantee that the restaurants won't be liable if the insurance company fails.
